1. Introduction

Purpose

These Terms are intended to regulate the relationship between Picky Zone ("we", "the platform") and users (sellers and buyers), and to define the rights, responsibilities, and obligations of each party when using the platform.

Acceptance

By using Picky Zone, you fully agree to comply with all the provisions outlined in this document and confirm that you are legally eligible to do so.

2. Definitions

  • Platform: Refers to Picky Zone, the multi-vendor e-commerce platform that enables sellers to offer their products and buyers to purchase them.

  • Seller: Any individual or entity registered on the platform to list and sell products.

  • Buyer: Any user who purchases products via the platform.

3. Account Registration

Eligibility

  • Users must be at least 18 years old to create an account.

  • Businesses or entities must provide valid legal documents upon registration.

Responsibility

  • Users are responsible for maintaining the confidentiality of their login credentials.

  • Any activity conducted through the account is the sole responsibility of the account holder.

4. Seller Obligations

Product Listings

  • Sellers must provide accurate and complete descriptions of their products.

  • Listing any illegal or prohibited products is strictly forbidden.

Pricing and Promotions

  • Sellers must set fair and transparent prices.

  • Prices cannot be changed once an order is confirmed.

Shipping and Delivery

  • Sellers are responsible for preparing and shipping products within the agreed timeframe.

  • Tracking information should be provided when available.

Returns and Refunds

  • Return policies must be clearly stated and honored once published.

  • Sellers are obligated to handle returns, exchanges, and refunds in compliance with their policies.

Legal Compliance

  • Sellers must comply with all applicable local laws, including consumer protection regulations.

5. Buyer Obligations

Purchasing and Payment

  • Buyers must provide accurate details when placing orders.

  • Payments must be made using the approved methods available on the platform.

Reviews and Feedback

  • Reviews must be honest, constructive, and free of offensive or misleading content.

6. Fees and Payments

Fees

  • The platform may charge sellers various fees, including commissions or listing fees, as clearly outlined in advance.

Payment Terms

  • Seller earnings will be transferred according to a defined payout schedule after deducting applicable fees.

Taxes

  • Each party is responsible for any taxes due under applicable Jordanian laws.

7. Platform Responsibilities

Service Availability

  • The platform strives to maintain continuous operation but does not guarantee uninterrupted access due to maintenance or technical issues.

Data Security

  • The platform is committed to protecting user data in accordance with its Privacy Policy.

Dispute Resolution

  • The platform offers a mediation mechanism to help resolve disputes, but it does not assume full legal responsibility for transactions between users.

8. Intellectual Property

Ownership

  • All content, branding, software, and design elements of Picky Zone are the exclusive property of the platform.

Licenses

  • By uploading product content, sellers grant the platform a non-exclusive license to use, display, and market this content for operational purposes.

9. Termination

Termination Rights

  • The platform reserves the right to suspend or terminate any account that violates these Terms without prior notice.

  • Users may delete their accounts at any time through account settings or by contacting support.

Effect of Termination

  • Account termination results in the loss of access to user data, subject to the obligation to complete ongoing transactions.

10. Liability and Disclaimers

Limitation of Liability

  • The platform is not liable for losses, damages, or issues arising from user transactions or product quality.

Disclaimer of Warranties

  • The platform makes no warranties, express or implied, regarding the accuracy, quality, or suitability of products sold by sellers. This responsibility lies solely with the seller.

11. Amendments

  • The platform reserves the right to amend these Terms at any time.

  • Users will be notified of any changes via email or platform announcements.

  • Continued use of the platform after such updates constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

  • These Terms shall be governed by and interpreted in accordance with the laws of the Hashemite Kingdom of Jordan.

  • The Jordanian courts shall have exclusive jurisdiction over any disputes arising under these Terms.

14. Miscellaneous

Severability

  • These Terms constitute the entire agreement between the user and the platform and supersede all prior agreements, whether written or oral.

    1. المقدمة

    الغرض

    تهدف هذه الشروط إلى تنظيم العلاقة بين إدارة منصة بيكي زون ("نحن"، "المنصة") وبين المستخدمين (البائعين والمشترين)، وتحديد الحقوق والالتزامات والمسؤوليات الخاصة بكل طرف عند استخدام المنصة.

    القبول

    باستخدامك لمنصة بيكي زون، فإنك تقر بموافقتك الكاملة والملزمة على الالتزام بجميع الشروط والأحكام الواردة في هذه الوثيقة، وتُقر بأنك مؤهل قانونيًا لذلك.

    2. التعريفات

    • المنصة: تشير إلى منصة بيكي زون للتجارة الإلكترونية متعددة البائعين، والتي تُتيح للبائعين عرض منتجاتهم وللمشترين شراء هذه المنتجات.

    • البائع: أي فرد أو جهة تقوم بالتسجيل على المنصة بهدف عرض أو بيع منتجات.

    • المشتري: أي مستخدم يقوم بشراء المنتجات من خلال المنصة.

    3. إنشاء الحساب

    الأهلية

    • يجب أن يكون عمر المستخدم 18 عامًا أو أكثر لإنشاء حساب.

    • في حال كانت الجهة المسجّلة شركة أو مؤسسة، يجب تقديم الوثائق الرسمية المطلوبة.

    المسؤولية

    • المستخدم مسؤول عن سرية معلومات حسابه.

    • أي نشاط يتم باستخدام الحساب يُعتبر من مسؤولية صاحبه.

    4. التزامات البائعين

    عرض المنتجات

    • يجب تقديم وصف دقيق وصحيح لكل منتج.

    • يُمنع عرض منتجات مخالفة للقانون أو لسياسات المنصة.

    التسعير والعروض

    • يلتزم البائع بتحديد أسعار عادلة وواضحة للمنتجات.

    • لا يجوز تعديل السعر بعد تأكيد الطلب.

    الشحن والتوصيل

    • يتحمل البائع مسؤولية تجهيز الطلب وشحنه خلال الفترة المتفق عليها.

    • يجب توفير معلومات تتبع الطلب إن توفرت.

    المرتجعات والاسترداد

    • يجب أن تكون سياسة الإرجاع واضحة وملزمة للبائع بمجرد نشرها.

    الالتزام بالقوانين

    • يلتزم البائع بجميع القوانين المحلية، بما في ذلك قوانين حماية المستهلك.

    5. التزامات المشترين

    الشراء والدفع

    • يجب على المشتري التأكد من دقة معلوماته عند الشراء.

    • الدفع يتم عبر الوسائل المعتمدة في المنصة.

    التقييمات والمراجعات

    • يجب أن تكون التعليقات صادقة وبناءة وخالية من الإساءة أو التضليل.

    6. الرسوم والمدفوعات

    الرسوم

    • قد تُفرض رسوم على البائعين تشمل عمولات على المبيعات أو رسوم خدمات.

    شروط الدفع

    • تُحوّل أرباح البائعين حسب جدول زمني واضح بعد خصم الرسوم.

    الضرائب

    • يتحمل كل طرف مسؤولية الامتثال للضرائب وفق قوانين الأردن.

    7. مسؤوليات المنصة

    توفر الخدمة

    • تسعى المنصة إلى ضمان استمرارية التشغيل، لكن لا تضمن عدم حدوث انقطاعات مؤقتة بسبب أعمال الصيانة أو ظروف تقنية.

    أمان البيانات

    • تلتزم المنصة بحماية بيانات المستخدمين وفقًا لسياسة الخصوصية المعتمدة.

    حل النزاعات

    • توفّر المنصة آلية وسيطة لمعالجة النزاعات، لكنها لا تتحمل مسؤولية قانونية كاملة عن التعاملات بين المستخدمين.

    8. الملكية الفكرية

    الحقوق

    • جميع محتويات المنصة (الشعارات، التصميم، البرمجيات) مملوكة حصريًا لـ بيكي زون.

    التراخيص

    • يمنح البائع المنصة ترخيصًا غير حصري لاستخدام محتوى المنتجات لأغراض تشغيلية وتسويقية ضمن المنصة.

    9. الإنهاء

    شروط الإنهاء

    • تحتفظ المنصة بالحق في تعليق أو إنهاء أي حساب يخالف الشروط دون إشعار مسبق.

    • يمكن للمستخدم إنهاء الحساب في أي وقت من خلال الإعدادات أو التواصل معنا.

    أثر الإنهاء

    • يؤدي إغلاق الحساب إلى إلغاء الوصول إلى جميع البيانات، مع الالتزام بإتمام الطلبات الجارية إن وُجدت.

    10. المسؤولية وإخلاء المسؤولية

    تحديد المسؤولية

    • لا تتحمل المنصة أي مسؤولية عن خسائر أو أضرار تنشأ عن التعاملات بين المستخدمين أو عن المنتجات المعروضة.

    إخلاء المسؤولية

    • لا تقدم المنصة أي ضمانات بشأن جودة أو صلاحية أو دقة المنتجات؛ هذه المسؤولية تقع على عاتق البائع.

    11. تعديل الشروط

    • تحتفظ المنصة بحق تعديل هذه الشروط في أي وقت.

    • سيتم إشعار المستخدمين عبر البريد الإلكتروني أو من خلال إشعار داخل المنصة.

    • استمرار الاستخدام بعد التعديل يُعتبر قبولًا ضمنيًا بالتغييرات.

    12. القانون والاختصاص القضائي

    • تخضع هذه الشروط وتُفسر وفقًا لقوانين المملكة الأردنية الهاشمية.

    • تختص المحاكم الأردنية بالنظر في أي نزاع ينشأ بموجب هذه الشروط.

    14. أحكام عامة

    قابلية الفصل

    • إذا تبين أن أي بند من هذه الشروط غير قانوني أو غير قابل للتنفيذ، فإن باقي البنود تبقى سارية المفعول.

    الاتفاق الكامل

    • تشكل هذه الشروط الاتفاق الكامل بين المستخدم والمنصة، وتُلغي أي اتفاقات سابقة سواء كانت شفوية أو مكتوبة.
